Terms of Service
These Terms of Use are provided by DIGIMASTY IT SERVICES PRIVATE LIMITED (herein collectively referred to as the "team," "we," "our," or "us"). By creating a user account, accepting the user terms and privacy policy posted in the app, or otherwise accessing or using the service, you acknowledge that you have read, understood, and agree to be bound by this end user license agreement and our privacy policy. If you do not agree to the end user license agreement or our privacy policy, you should not use the service. We reserve the right to modify the end user license agreement and our privacy policy at any time without notice, and your continued use of the app will be considered your acceptance of the revised end user license agreement. If you do not agree to the revised end user license agreement, please do not use the app.
Please note that this app and the services provided herein do not offer "real money gambling." No actual money is required to play, and the service is intended for entertainment purposes only. You cannot obtain any actual money from the gameplay itself. You represent and warrant that you have the right, authority, and capacity to accept these terms and to abide by them, that you are of legal age, and that you have fully read and understood the terms. By creating a user account or accepting the user terms, you confirm that you have read and agree to be bound by these terms.
1. Limited Revocable License
1.1. Coins
The services may include virtual in-game tokens ("Coins"), including but not limited to chips, coins, credits, or points that may be provided for free when players finish assignments or watch advertisements. On the site, games are currently played with Coins. Subject to your agreement and continuing compliance with these terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the service solely for your personal, private entertainment and no other reason. Other than a limited personal, revocable, non-transferable, non-sublicensable license to use the Coins with the services, you have no right or title in or to any such Coins appearing or originating with the services or any other attributes associated with the use of the services or stored within the services. You acknowledge and agree that your license to use the service is limited by these terms, and if you do not agree to or act in contravention of these terms, your license to use the service may be immediately terminated. We have the absolute right to manage, regulate, control, modify, and/or eliminate such Coins as we see fit in our sole discretion to the extent legally permissible, and we shall have no liability to you or anyone for the exercise of such rights.
1.2. Transfer or Sale of Coins
The transfer or sale of Coins by you to any other person is strictly prohibited. Nor may you sell or assign your user account to any other person under any circumstances. Any attempt to do so in violation of these terms will result in the closure and forfeiture of the user account and may result in a lifetime ban from the services and possible legal action.
The game itself does not earn any real money and does not provide services for refunds, exchanges, or cashing in real money or any other currency either. This game prohibits users from engaging in fraudulent activities under the guise of conducting online or offline virtual currency transactions. If a user is found to have engaged in the aforementioned prohibited behaviors, the game will immediately close the account and freeze the virtual currency in the user's account. If it involves illegal activities, it will be transferred to judicial authorities for processing.
These terms do not confer upon you any right, title, or interest in or to the service.
The service is granted to you on a license basis, not sold. You acknowledge and agree that we, along with our licensors, retain all rights, title, and interest in and to the service, including all intellectual property rights, and that such ownership remains vested in us even after installation on your device. You further agree not to delete or modify in any manner the copyright, trademark, or other proprietary notices or markings that may appear on the service.
Unless otherwise explicitly stated and specified in these terms, you agree not to:
· Sell, rent, distribute, transfer, license, sublicense, lend, or otherwise assign any rights pertaining to any part of the service to any third party.
· Copy, modify, or create derivative works based on the service (including but not limited to any software that comprises a part of the service), including but not limited to making adaptations or modifications to the service.
· Reproduce the service or any part thereof in any form or by any means.
· Utilize the service in any unauthorized manner, including but not limited to trespassing or overloading network capacity.
· Disassemble, decompile, reverse engineer, or attempt to derive the source code of the service in whole or in part, or permit or authorize a third party to do so, except to the extent that such activities are explicitly permitted by law.
· Make the service accessible to multiple users through any means, including by uploading the service to a file-sharing or hosting service or by making it available over a network where it can be accessed by multiple devices concurrently.
· Misrepresent the ownership or source of the service.
· Scrape, build databases, or otherwise create permanent copies of any content derived from the service.
· Utilize the service in any way that harasses, abuses, stalks, threatens, defames, or otherwise infringes upon or violates the rights of any other party.
2. Eligibility
Your eligibility for continued use of the service is contingent upon your ongoing compliance with these terms, particularly:
· You must be over 18 years of age or the minimum legal age of majority, whichever is higher in the jurisdiction of your residence, and be legally allowed to participate in the games and access the service under the laws of the applicable jurisdiction(s).
· You understand and accept that we do not provide legal advice or assurances, and it is your sole responsibility to ensure compliance with all applicable laws and to have the complete legal right to use the service.
· You will monitor your user account and ensure that no child under the age of 18 can access the service using your user account. You accept full responsibility for any unauthorized use of the service by minors.
· You must not reside in or access the games or service from the states of Washington, Idaho, Nevada (USA), or Quebec (Canada).
· You may participate in the games solely for personal recreational and entertainment purposes.
· All information you provide to us during the term of these terms must be true, complete, and correct.
· You will not engage in any fraudulent or unlawful activity related to your participation in the games and will not use any software-assisted methods or techniques for your participation. We reserve the right to invalidate any such participation.
3. Your User Account
· You confirm that you will not share your user account or password with anyone else or permit unauthorized access or use of your user account. You will not access or use a user account without our written permission if it has been rented, leased, sold, traded, or otherwise transferred.
· Notify us immediately if you suspect that the security of your user account has been compromised.
· You are responsible for maintaining the confidentiality of your user account and accept responsibility for all uses of the user account, including any purchases.
· We reserve the right to close inactive user accounts after sixty days. We may, but are not required to, notify you prior to such closure.
· If you wish to close your user account, you may do so by contacting customer support. Closing your user account will forfeit all rights to use or benefit from any Coins associated with your user account.
· We reserve the right to refuse or close a user account at our sole discretion.
4. Verification
· You acknowledge our right to conduct verification checks as required by law or regulation or as we reasonably determine. You agree to comply with all verification checks promptly.
· We may restrict your user account until verification checks are completed to our satisfaction.
· Required documents may include identification documents (including photo ID), proof of address, and documentation of wealth or funds sources.
· If you fail to provide requested documents within 40 days, we may, at our discretion, deactivate or restrict your user account.
· You acknowledge that we may use third-party service providers for verification checks and must enable location services on your device or PC to access the service.
5. Intellectual Property
· These terms grant only the right to use the service and do not convey any ownership rights.
· All rights, title, and interest in the service, including intellectual property rights, remain our sole property or the property of our licensors.
· Your use of the games does not convey any ownership rights in the intellectual property. All titles, codes, game client and server software, designs, sounds, effects, concepts, methods, text, data, user accounts, themes, objects, characters, stories, dialogue, locations, artwork, animations, images, graphics, documentation, gaming history, recordings, and moral rights remain our property or the property of our licensors.
· You acknowledge that you have no ownership or property interest in the user account and all rights in the user account remain vested in us.
6. Responsibility for User-Generated Content
· 6.1. You are responsible for complying with all laws applicable to your user content. You agree not to submit any defamatory, inaccurate, abusive, obscene, offensive, sexually oriented, threatening, harassing, racially offensive, illegal, or infringing material.
· 6.2. You must provide accurate information to us and promptly notify us of any changes that render previous information inaccurate.
· 6.3. We may delete User Content at our discretion but are under no obligation to do so. We assume no responsibility for monitoring User Content.
· 6.4. You grant us a worldwide, royalty-free license to reproduce, modify, create derivative works from, publish, distribute, sell, transfer, transmit, display, and use any User Content.
· 6.5. You further grant us the right to use and exploit your name, likeness, and any other information or material included in your User Content without any obligation to you.
· 6.6. You are solely responsible for your User Content. We disclaim any responsibility for backing up or retaining User Content.
· 6.7. Prohibited User Content includes, but is not limited to, content that promotes racism, bigotry, hatred, physical harm, harassment, sexual or offensive content, terrorism, religious hatred, illegal activities, unauthorized commercial content, or content promoting the services of competitors.
7. Indemnity and Limitation of Liability
· 7.1. To the extent permitted by law, we and our subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:
o Your access to or use of, or inability to access or use, the Service;
o Your access to or use of, or inability to access or use, the Service;
o Any content or information obtained from the Service or reliance on the Service;
o Unauthorized access, use, or alteration of any material or content.
· 7.2. In jurisdictions where limitations on liability are not permitted, the above limitations may not apply to you. Nothing in these Terms removes or supersedes your rights as a consumer.
· 7.3. Our total liability, and that of our affiliates, is limited to the amount you have paid us in the preceding 180 days.
· 7.4. We are not liable for any damages caused by viruses, bugs, human error, system failures, or errors, failures, or delays in transmissions or network connections. We cannot guarantee continuous or secure access to the Service.
· 7.5. We are not liable for any damages, claims, liabilities, or costs you incur in connection with content, products, or services offered by third parties we cooperate with.
· 7.6. You release us and our subsidiaries, affiliates, partners, officers, directors, employees, and agents from any liabilities arising from the acts or omissions of such third parties.
· 7.7. You agree to indemnify and hold us harmless from any claims or demands, including attorneys' fees, arising from your use of or access to the Service, your breach of these Terms, or your violation of any law or third-party rights.
· 7.8. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence or willful misconduct.
8. Miscellaneous
· 8.1. These Terms constitute the entire agreement between you and us regarding your use of the Service and supersede all prior agreements.
· 8.2. You are solely responsible for any taxes applicable to your use of the Service.
· 8.3. We are not liable for any failure to perform our obligations due to events beyond our reasonable control.
· 8.4. If any provision of these Terms is found to be unlawful, void, or unenforceable, it shall be severable and shall not affect the validity and enforceability of the remaining provisions.
· 8.5. These Terms are personal to you and are not assignable without our prior written consent. We may assign our rights and obligations under these Terms at our discretion.
· 8.6. These Terms contain the entire understanding between you and us and supersede all prior understandings.
· 8.7. In the event of a change of control, merger, acquisition, or sale of assets, your User Account and associated data may be transferred to the purchaser or acquiring party.
· 8.8. Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision or our rights under these Terms.
